GENERAL TERMS & CONDITIONS
1. IMPORTANT NOTICE:
The signatory, who purchase our package on behalf of other tour member are deemed to have read, understood, agreed and satisfied with the itinerary, and the following terms & conditions.
2. CHECK IN:
Tour members are advised to check-in at meeting point at least 15 minutes before departure time. NO REFUND or REPLACEMENT for those who are late and miss the group departure. Tour members shall be responsible to bear all additional costs for arrangement to join the group at the next destination. The company shall not be liable for any claim due to cancellation of tours, meals and/or accommodation if the tour members miss the group departure and join the group at the next destination.
3. TRAVEL DOCUMENTS:
Tour member(s) shall responsible to obtain the necessary documents such as passport, visas, social visit passes, exit permits, health certificates, vaccinations or any other documents if required by the relevant Government authorities.
4. AMENDMENT CHARGES:
i. Upon confirmation of the tour any subsequent change made to reservation is subject to an amendment charge of MYR50.00(USD20.00) per person per change. (Foreign exchange rates are subject to change without prior notice).
ii. No change can be made within 8 working days before the date of departure.
iii. Changing the entire reservation constitutes a cancellation of original reservation and subject to cancellation charges as defined in the cancellation policy (see No. 5)
5. CANCELATION CHARGES
i. Cancellation of reseravation must be made in writing to avoid misunderstanding. If the company receives notice to cancel 30 days or more before the departure date, a minimum administrative fee of 10% of the tour deposit per person will be levied.
ii. If notice of the cancellation received 29 days or less before the date of departure the following charges will apply.

6. POSTPONE OF DEPARTURE DATE:
This is a confirmed departure date, POSTPONE or CHANGE OF DEPARTURE DATE is NOT ALLOWED after booking. POSTPONE or CHANGE OF DEPARTURE DATE is applicable only if the country of visit is regarded as unsafe to travel. Our company reserves the right to postpone the departure date, reschedule the itinerary or change the place of stay if deem necessary.
7. UNUSED SERVICE
NO REFUND, REPLACEMENT OR EXCHANGE OF CASH can be made in respect of services included in the tour fare and itinerary but utilized.
8. EXTENSION OF STAY OF DEVIATION:
Tour member(s) shall be resposible for their own transportation, accommodation, or any other expenses incurred if they extend their stay at the end of the tour, or make any deviation during the tour.
9. TOURS NOT MATERIALIZE:
Be Tourist Sdn Bhd reserves the right to cancel the package at least one day before the departure if there is a shortage of tour member to form a group. Full payment will be refunded. The company shall not be liable to any further claim.
Be Tourist Sdn Bhd and its associate agent shall not be liable for any liability or claim due to injury, damage or loss of properties, accident, hospitalized, robbery, theft, hijack, food poisoning, cancel or shorten program indicated in the itinerary due to delay, traffic congestion or vehicle breakdown during the tour, or any cause beyond the control of the company.
The tourist guide or our company's representative reserves the right to replace other sightseeing programs in case of cancellation of program, closure of places of visit indicated in the itinerary due to bad weather condition, traffic congestion or vehicle breakdown or whatever reasons. No refund or compensation if replacement of program is not available due to shortage of time.
11. PERSONAL DATA NOTICE
The BE TOURIST SDN BHD (BE TOURIST) is required to comply with the Personal Data Protection Act 2010 (the “Act”), which regulates the processing of personal data in commercial transactions. For the purpose of this Personal Data Notice, the terms “personal data” and “processing” shall have the meaning as prescribed in the Act.
This Personal Data Notice applies to any person whose personal data is processed by Be Tourist or on behalf of Be Tourist.
i. This Personal Data Notice serves to inform you how your personal data is being processed by Be Tourist.
ii. This personal data processed by us may include your name, Passport No/IC No, contact details, email address and any other personal data required for the purposes set out in paragraph 3 below.
iii. Be Tourist may use your personal data for the following purposes (collectively referred to as the “Purposes”):
(a) To process your registration form for tour events (including conferences) organized by Be Tourist and collaborative partner(s) and for administrative purpose such as name list, issuance of invoice, official receipt).
(b) To communicate with you on the confirmation and matters in connection to the Be Tourist tour event;
(c) To notify you of any changes to our tour events which may affect you;
(d) To respond to your inquiries or complaints; and
(e) Such other administrative purpose which relate to the above.
(f) To submit the information required by Ministry of Tourism and Culture, transportation, accommodation and any others for the tour events.
iv. Your personal data is collected from various sources, including information you have provided us, information from third parties and information in the public domain.
v. You may access and request for correction of your personal data. Please contact us as follows if you have any inquiries or complaints in respect of your personal data:

In accordance with the Act:
(a) We may charge a fee up to USD 30 and equivalent for processing your request to amend your personal data; and
(b) We may refuse to comply with your request for access to or correction of your personal data.
vi. Be Tourist shall retain your personal data from the date of collection for as it is necessary for the fulfillment of the Purposes or for compliance with the law or legal obligations by Be Tourist. Be Tourist shall stop processing your personal data when you write to Be Tourist using the contact details in paragraph 5 above to withdraw your consent.
vii. Unless otherwise specified by us at the time the personal data is collected, it is obligatory that you supply us the personal data requested for by us. Failure to supply us with your personal data may render us unable to carry out the purposes.
viii. You undertake and warrant to Be Tourist that your personal data is accurate, complete, not misleading and up-to-date. The onus is on you to update Be Tourist if your personal data has changed.
ix. Be Tourist reserves the right to update and amend this Personal Data Notice from time to time. Be Tourist will notify you of any changes via announcement on Be Tourist’s website or through other reasonable means of providing notice as Be Tourist may deem appropriate. Any changes to this Personal Data Notice will be effective immediately upon notice to you.
